     Western New York gym owner Robbie Dinero won a court victory over the state of New York that will allow him to open his gym at full capacity.  State Supreme Court Judge Paul B. Wojtaszek allowed the gym to open at full capacity. The judge said there was a “right to normalcy” and he threw out the state’s 25% capacity limit. Owner Robbie Dinero was naturally thrilled with the outcome,

    “This is a huge win. The fact that the precedent has been set that we can open at full capacity, so long as we abide by the safety guidelines and protocols that do work, that’s a huge win.”

MASK LEGAL ISSUES

 

  1. Did you know if you operate a business and require a mask to enter or to serve someone, and a customer states that they have a medical exemption and you do not serve them, your business can be sued? That is why many businesses have taken professional legal advice and now post this sign:

If pressed, all a customer needs to do is to present this:  MASK-EXEMPTION-waiver 05-09-20 or this; Civil Rights Violation.  If you or your employees  sign the “contract” your business can be held accountable, and either party can call the police (policy enforcement) or Sheriff, only the most ill-informed officer will sign it. If they do, jackpot!  (Ok, the last thing a customer may want to do is go to court, so let the dead bury the dead. Maybe they assign the right to collect to the INTERNAL REVENUE SERVICE DEPARTMENT OF THE TREASURY.  They may consider it a donation to the people of the planet.)
