The two men who were sent to jail were sent down for more than spraypainting a mosque. There wasn't just a poppy, they also spraypainted the initials EDL and NEI – North-East Infidels – as well as the words “no surrender”, and the cross of St George, making this arguably a racist attack. They also spraypainted this elsewhere, as well as bricking shops, simply because they were foreign owned (ironically, some of the shops they attacked were selling poppies). They also shared messages between themselves saying they were going "muzzy bashing" (their words, not mine). Their crimes went a lot further than those of Emdadur Choudhury and Tohseef Shah. Don't get me wrong, I'm not condoning what they did, matter of fact is that I think their behaviour is a disgrace too.

However, Tohseef Shah was actually charged £500, and given a two year conditional discharge, meaning that if he was charged again, he'd be sentenced doubly, and likely go to jail. Sadly, there isn't really much the CPS can charge Emdadur Choudhury with, as poppy burning isn't necessarily a crime, despite it being massively fucked up, so there is only a fine they can hit him with.
