END USER LICENSE AGREEMENT — PRIVATE AUTH

 

This End User License Agreement (“Agreement”) is a legal contract between you (“User”) and Maxim Maevschi, the creator and publisher of the mobile software application Private Auth (“we”, “us”, or “our”). By downloading, installing, or using Private Auth (the “App”) from the Apple App Store, you confirm that you are at least 4 years old and that you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not install or use the App.

 

1. Relationship with Apple

This Agreement is concluded between you and Private Auth only, not with Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide any maintenance, support, warranty, or address any claims related to the App. Apple is a third-party beneficiary of this Agreement and may enforce it against you.

 

2. Grant of License

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to install and use Private Auth on any Apple-branded device that you own or control, subject to the terms of this Agreement and Apple’s App Store Terms of Service. You must not share, sell, lease, sublicense, reverse-engineer, modify, disassemble, or create derivative works based on the App.

 

3. ntended Use and Restrictions

The App is for personal, non-commercial use only. It is not intended for environments that require regulatory compliance, such as HIPAA, FISMA, or GLBA. You must not use the App for unlawful purposes or in any way that violates applicable laws or third-party rights.

 

4. System Requirements

Private Auth requires devices running iOS version 1.0 or higher. We recommend using the most recent firmware available. We do not guarantee compatibility with future software or hardware updates.

 

5. Support and Contact

Support and maintenance for Private Auth are provided solely by us. For assistance, please contact us at maximmaevschi@outlook.com. Apple is not responsible for providing support or handling complaints about the App.

 

6. Account Responsibility

If the App provides login or account features, you are responsible for keeping your credentials secure. Any activity carried out under your account is your responsibility, and we are not liable for any loss caused by unauthorized use.

 

7. Data and Privacy

We may collect and process personal and usage data in accordance with our Privacy Policy. By using the App, you consent to the collection and use of such data for functional, diagnostic, or analytical purposes, and for service improvement. We do not sell or misuse your data.


8. User Submissions and Content

Although Private Auth does not include public posting features, you may have opportunities to send content such as feedback, images, or other data. You warrant that any content you submit is lawful, owned by you or properly licensed, and does not violate any rights or laws. You must not submit content that is offensive, harassing, misleading, illegal, or inappropriate.

 

9. Ownership and Intellectual Property

You retain ownership of any content you legally submit to us, but by doing so, you grant us the right to use such content internally for improvement and development purposes without compensation. All intellectual property in the App itself, including trademarks, UI design, and source code, remains the property of Private Auth and is protected by applicable laws.

 

10. Limitation of Liability

We provide the App “as is” without warranties of any kind. We are not liable for any loss, damages, or harm resulting from your use of the App, including loss of data or functionality due to software updates, system changes, or unauthorized modifications of the App.

 

11. Legal Compliance

You represent that you are not located in a U.S.-embargoed country and are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable laws and export regulations regarding your use of the App.

 

12. Termination

This Agreement remains in effect until terminated by you or us. You may terminate it by deleting the App from your device. We may terminate it at any time without notice if you violate any terms of this Agreement. Upon termination, you must cease all use of the App and delete all copies.

 

13. Third-Party Terms and Open Source Components

Some components of the App may include open-source libraries governed by separate licenses. You agree to comply with those terms. We ensure that our use of third-party services complies with applicable licensing requirements.

 

14. Apple as Third-Party Beneficiary

In accordance with Apple’s developer agreement, Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

 

15. Intellectual Property Claims

In the event of any third-party claim that Private Auth or your use of the App infringes on intellectual property rights, we—not Apple—are solely responsible for investigating, resolving, and satisfying such claims.

 

16. Subscriptions and Payments

Private Auth may offer subscription-based access to certain features or content. Payments are processed via your Apple ID account, and subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage subscriptions through your Apple ID account settings. No refunds or partial refunds are provided unless required by law.

 

17. Severability and Modifications

If any term of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force. Any amendments to this Agreement must be made in writing and accepted by both parties.
