Since we are talking about getting a work permit by getting married you obviously have to have married a US citizen or a green card holder to qualify to file for your work permit. You also have to be inside the US when applying for a work permit because obviously if you are not even in the US there is no reason for the USICS to give you a work permit.

 

There are two ways in which you can apply for your work permit. The first way is to request your work permit when you file for your green card. Under this approach, you fill the form I-765 and send it along with your green card application. The second way is to wait until you receive a notice from the USICS that they have received your green card application and then file for your green card by filing the form I-485.

 

Normally, the USICS issues work permits in about 90 days but it all depends on their caseload Currently it is taking them anywhere between 3 months to 10 months because they have a huge case load. Also, if you are applying for a green card by marrying a US citizen you will get your work permit sooner than if you were applying it by marrying a green card holder.

 

There are two things to keep in mind. Do not try to work until you have received your work permit. If you already have an existing work permit like H1-B you can continue to work else you will be violating the immigration law. Second be sure to double check your application. Make sure all the information is correct and you have attached all supporting documents else it may take longer to process your petition and may even get denied.
