Orthopedic problems at INSS: social security expert explains topic based on real case

In January, the Federal Court received a complaint from the Federal Public Ministry (MPF) against 22 people suspected of participating in the fraud. Two are still at large.

Outraged, several Internet viewers contacted the newsroom to report their difficulties in obtaining social security benefits.

The G1 met four cases in four special reports with the lawyer specialized in Social Security, Katia Macedon. In this matter, the theme is orthopedic problems, based on the case of Jesse de Paula, 46, a resident of Araguaia.

Case 2 - Orthopedic problems

Jessed de Paula worked since 2013 as a school bus driver when, in 2016, she had to leave her job due to pain. He was diagnosed with six herniated discs, osteoporosis, arthritis, arthritis and parrot's beak. In 2016, Jesse obtained the disability benefit, but in March 2017 the payment ceased, as provided for in the INSS document.

Jesse claims that she was an orthopedic expert witness in the Federal Court and that the incapacity was verified, but the INSS appealed and did not grant the sickness benefit anymore.

According to Jesse, the INSS considered him apt to work, but, after an expertise in the DMV, he took care of his driver's license. Therefore, he cannot return to the role of driver, from which he has been away since last year.

Without the benefit and without working, Jesse says that she survives on the goodness of her garage friends, who donate basic food baskets every month; one of them also helps to fund the controlled drugs of his 11-year-old son, who has hyperactivity. The family's only income comes from the cleaning work that Jesse’s wife does and from the savory and salty snacks that the couple started selling.

Expert speech

According to specialist Katia Macedon, orthopedic problems such as Jesse’s lead the ranking of diseases and injuries that qualify taxpayers to receive benefits. According to her, about 70% of the INSS benefits are granted for these types of diseases.

The expert also says that, just as Jesse did in the Federal Court; it is advisable that the insured person take medical reports, exams, certificates and statements regarding the beginning of the disability and current ones. Private unilateral skills are also allowed.
