What could be sadder than a mother who just lost her young son? To Carmen Foucault, the outrage and despair are much greater than the sadness.

 

James Foucault, a 24-year-old Marine vet who served two tours in Afghanistan, was hit by a car while riding a Harley and died at Mercy Hospital in Costa Mesa.

 

Two days after the funeral, a $41,000 hospital bill reached the door of Mrs. Foucault claiming to be the cost for keeping him alive an extra day for organ donations. She was shocked by such an outrageous behavior of the hospital.

 

Irwin Greenhouse, the hospital’s chief administrator, expresses his dreadful sorry and admits that “It’s a mistake the bill went to Mrs. Foucault” as normally the donor bank would cover most of the cost.

 

“Can you believe it?” Mrs. Foucault said, “They kept him alive to get his organs, then they send me the bill for keeping him alive.”

 

When informed of the brain death of his son, Mrs. Foucault accepted the doctor’s suggestion of donating his organs because she thought that was what her son would want.

 

“They say he had real serious head injuries and would never regain consciousness,” she said. “He was always helping other people, so I agreed.”

 

Mrs. Foucault didn’t recall clearly of being told about the expensive cost of keeping his son alive for the organ donations.

 

“I can’t remember them saying anything about it. But I wasn’t understanding everything, wasn’t, couldn’t, listen too good,” she said.

 

Mrs. Foucault buried his son with the help of some friends and families when her savings and his medical insurance weren’t enough to cover the expenses. The lien made things even worse.

 

“Those thieves put a lien on my son’s estate for $41, 000,” Mrs. Foucault said. “With the lien, I can’t touch the saving we had together.”

 

The spokeswoman from the hospital, Christina Snyder claims, “The Lien is standard procedure to ensure a bill is paid.” But she agreed that the bill should be reexamined.

 

Mrs. Foucault hired a lawyer to seek justice, and such action appeared to be effective as the doctors and hospital began to apologize for their mistakes after the lawyer called.

 

Mr. Greenhouse promised to review the billing procedures of their hospital to avoid such mistakes from happening ever again and remove the lien as one priority.

 

“Normally, Mrs. Foucault would be billed the cost of normally emergency care, but the donor bank has agreed to pick up everything in this case, everything,” Mr. Greenhouse said.

 

Although the hospital has been apologizing for their mistake and promising to remove the lien and pay the bill immediately, that’s not what Mrs. Foucault has heard till the moment.

 

“The whole thing is sickening and outrageous,” Mrs. Foucault said. “The lien hasn’t been removed, and the bill hasn’t been paid.”
