Tetrahydrocannabinol, or thc, is a psychoactive cannabinoid, which causes impairment. The psychoactive effects of thc are the reason cannabis was listed as a controlled substance under schedule 1 status in the first place. It is because of thc’s impairment potential that the farm bill definition of hemp specifically included controls on the level of thc to differentiate cannabis plants as either hemp or cannabis. According to federal law, delta 8 is legal due to the farm bill, passed in 2018. Its brother, delta 9, is illegal because it comes from marijuana and produces the classic high effects that come to mind when a person thinks of cannabis. However, since delta 8 thc comes from hemp, any u.S. State that allows the possession of hemp—which is nearly every state except for a few, such as idaho—also allows delta 8.

 

Delta-8 isn’t legal in all states, and different producers may choose not to ship to certain states because of its hazy legality. Be sure to check a producer’s website to see if they ship to your state. Surprisingly, states that have legal, adult-use cannabis laws don’t always allow delta-8. It’s always recommended to take a little bit at first and then wait for the onset of effects before taking more. One of those cases was recently dismissed based on essentially technical legal issues, and there is another challenge in a federal appellate course that will play out soon. As of early 2021, "Delta-8"/∆8-thc is one of the fastest growing segments of products derived from hemp. ∆8-thc has a double bond between the carbon atoms labeled 8 and 9. ∆9-thc has a double bond between the carbon atoms labeled 9 and 10. Research is still being conducted to pinpoint the exact effects of delta-8 thc. However, the national cancer institute has reported that it’s “an analogue of tetrahydrocannabinol with antiemetic, anxiolytic, appetite-stimulating, analgesic, and neuroprotective properties.

 

If you’re vaping delta-8, you should feel the effects within ten minutes or less; if taking edibles, wait at least an hour or two before taking more. If you are looking for effects similar to thc but with a reduced potency, delta-8 may be for you. If you seek relief from certain symptoms and don’t want to get intoxicated, you may want to try a cbd product.
