Sekaimon commits fraud.

It is unfortunate that it may seem complicated to explain how Sekaimon (together with Ebay) has committed this fraud against me, as it involves a series of E-Mails & other details as well as collusion ('conspiracy'?) between Sekaimon & Ebay to defraud me. I have tried to provide the relevant details without excessive tangents that may confuse the issue. I wish it were simpler 2 explain, like 'I sent them something and they never paid me'. They DID pay, but then they commit fraud to try and take the money away from me = a bit more complex.

Below I have compiled some written proof Sekaimon commits fraud. I saved the relevant E-mails I received, ads, etc., so if anybody wants more detail (for investigation & prosecution of them for fraud, etc.), please contact me at 'balkanguy at live dot com' =)

What remedy would I like: I want that Ebay account of mine reinstated so I can post ads and sell products through it again, and for any and all negative marks on that Ebay account of mine relating to the transaction to be erased, and any and all collection efforts by them on this matter stop, including those by any organization(s) who they may have 'sold off' this fake debt to. I also want them to remove any negative marks that may have been put on my public credit rating relating to this. What Ebay & Sekaimon have together done amounts to a combination of fraud and defamataion against me, and as they both have deep pockets, maybe a lawyer would want to take up this issue? Let me know.

I have over time received various 'collection notices' via onine, telephone, and even physical mail relating to a fake 'debt' that was imposed on me through their fraudulent activity. Their fraud also is against Ebay, who they have verifiably (in writing) lied to. They claim to Ebay that they did not know they would be getting a repair item. Ebay knew it was a lie (with verifiable proof they lied via E-mail) and went along with it anyway, so Ebay is partly to blame for the fraud as well, because they are both trying to stick me with the fake bill.

The result of their fraud is not just that crime of lying for profit, but also defamation, as their lie about pretending they did not know they would be getting a repair item has cost me real money in terms of losing existing & potential business revenue on that Ebay account, the deletion of about 100 different product ads I posted (which took me significant time to create and post), and of course the fake 'debt' that their partners PayPal and various 'collectors' have tried to extract from me to the tune of $1,329.05! =(

Ebay Item title = "21 Day Delay ~ 1 Pair (2 units) Aurasound 18" PA Subs"

NOTE: In the ad title I clearly stated that I wait 21 days after payment before shipping. I also repeated it in detail in the ad itself, to be sure any potential buyer is aware of this and also to be sure payments clear on this relatively expensive item and can not be reversed after I send it (so to avoid other people ripping me off). I noted 'there are no returns on this item after it ships', clearly printed in the ad text.

This was especially important in the case of 'smallfamiliar' variants (all run by 'Sekaimon' parent company) because after they bid on my items SEVERAL TIMES I did some research on them and noted there are a lot of 'horror stories' about them, so I wanted to protect myself against any potential for getting scammed by them.

I sent to them...

I did some high power frequency sweeps on them both today before shipping and there is a problem with one of the drivers. There was no problem when I put it in storage about a decade ago, so I am not sure what it is. When pushing one of them manually it generates a bit of a scratchy sound like something is rubbing inside, and the same thing happens when powered =P

Maybe it was damaged during the initial testing phase long ago but did not show up until now in an audible way, or maybe the mechanism simply sagged under the weight of gravity from sitting around so many years ~ who knows. Let me know if you want to wait on a repair or swap for that one, or if you would prefer a refund for that unit, or a refund for the entire transaction.

One of them functions just fine. They are both 'new and tested', and one has not lived up to the latest test. I want you to always have the best =D I could maybe send the one and if you like it get others? It's all up to you. Let me know.

NOTE:

In the interim, 'smallfamiliar' filed an 'Item Not Received' complaint on Ebay, a remedy to which (proposed by Ebay on the complaint page) was to simply send the item(s) and provide shipping and tracking information. Since 'smallfamiliar' (under a variety of variations on that account name, including the one making the complaint) clearly intended to buy the item several times in the past, it was reasonable to assume they were upset with the delay so wanted their item more quickly.

I therefore sent the item to remedy the situation, and provided the shipping and tracking details to Ebay. 'Smallfamiliar' later disputed their intentions, but I WON the 'Item Not Received Complaint' dispute with Ebay, so in this case Ebay rightfully stood by their user contract and upheld my decision to send as remedy for their 'Item Not Received' complaint.

I went to the bank that handles the debt card & checking account that are linked to my PayPal account & had them send in a request for 'overdraft denial confirmation' and also obtained written proof they have frozen the account at my request. This is a preventive measure to avoid complications that may arise from additional false, frivolous complaints from you guys. I upheld the contract. You guys were informed of the minor defect that was exposed during pre-shipment testing, and it was repaired, and you confirmed (in writing via E-Mail from you through Fleabay) that U knew it was repaired B 4 U demanded I ship & provide tracking details 2 resolve your 'item not received' complaint. You guys do not have a case. You are just wasting Ebay's time and abusing sellers when you try do do this sort of run around, even demanding I offer a return and pay return shipping when the ad says 'no returns after shipment' and this was never amended via correspondence. Yes, I asked how long it would take to repair but it does never mean I would like you to ship the item and I never demanded you to do so.
I needed to know that information to ask our client if they accept this matter. ( they didn't accept the repaired item tho.)

I'm pretty sure we can receive a refund because I never demanded you to send the item, but asked to let me know what was going on with it.
Also, the item was shipped despite I asked you to issue a refund, not to ship the item that is not as described in the listing.

Please do not the matter more confusing.
Hope you concern the case simple and understand who should take a responsibility in this matter.

This message from them outlines and confirms their intentional lie to both me and to Ebay where they claimed they never demanded I ship the item. When somebody files an 'Item Not Received' complaint, it constitutes a demand to issue a refund IF the item will not be shipped to them. I was not 'holding the items hostage' or something. I was simply waiting for word on what they wanted do to. If they simply wanted a refund and nothing else, they could have simply ASKED me via Ebay's E-Mail interface. My account history there showed MANY instances of buyers asking for refunds and promptly receiving them from me.

At one point I had about 100 different items listed and would regularly get bids on different things. Sometimes people bid on items then change their mind = pretty simple. INSTEAD of this simple, clear route, 'smallfamiliar' chose to file an 'Item Not Received' complaint, so I made sure they RECEIVED the item as per the complaint request for shipping details. I also wanted to avoid a situation where Ebay puts bad marks on my account as if I were refusing to send something to a customer.

It is not my fault if 'smallfamiliar' can't understand English (or pretends not to), or prefers to use the WRONG methods and WRONG mechanisms to do business. Ebay sided with me on this and dropped their complaint in the 'Item Not Received' complaint because I provided the necessary remedy for the complaint = to simply send the item(s).)

I told them that as my ad stated, the items are guaranteed to work (I tested them both, uncovered a problem with one & repaired it, then tested again & confirmed they both work great), and that (as the ad clearly stated) there are no refunds on the item after shipping, and that they should NOT send them back to me for this reason AND because they already confirmed IN WRITING that they knew it would be a repair item.

These many 'smallfamiliar' and many other Ebay accounts are held by a company called 'Sekaimon', who (according to several web sites) $cam$ a lot of people. I could not be sure they would return the items to me in the good, working condition I sent them in, so declined their offer and noted that if they send them to me without my consent I legally do not have to issue a refund because I specifically told them not to return them to me. In addition to this, I would lose the shipping cost spent to fulfill their order, which was high due to the weight, and part of why my ad clearly said 'there are no returns on this item after it ships'.

Since then they repeatedly send me extortionate bull$hit messages like: "To avoid further collection activity, such as: possible referral to collection agency, and/or legal action, you must pay the amount you owe immediately. Please pay your past due balance of $1,329.05 on your... eBay account." The fake debt they are pretending I have with them is based on a LIE told to them by 'smallfamiliar', and it is reasonable to assume that Ebay KNOWS it is a lie, because I REPEATEDLY informed them about the customer knowing it would be a repair item, including the buyer confirming this IN WRITING via E-Mail on Ebay's own web site E-Mail interface so if they simply look at the messages they can see the confirmation for themselves.

It is my belief that since 'smallfamiliar' (and other 'Sekaimon' shell accounts) do so many millions of dollars in transactions with Ebay that they just side with them to help their big 'selling partner' overseas, rather than adhere to the rules of their user contract by siding with the person who simply follows the rules, informs the buyer of a repair, and ships the item after a buyer confirms they know about the repair and after an 'Item Not Received' complaint is received. In other words, I feel they are 'protecting the big fish', even though their behavior is 'predatory' and fraudulent (lying to obtain funds), and illegal.

Many corporations and companies often do illegal things. Why did Ebay side with ME over the 'Item Not Received Complaint' dispute, then flip on the issue? Their behavior is not only illegal but inconsistent as well, unless you take into account their 'help the big selling partner by assisting them in defrauding the seller' angle. In other words IT IS NOT JUST SEKAIMON (and their 'shells') AT FAULT HERE BUT ALSO EBAY ITSELF for knowingly assisting in Sekaimon's fraud(s).
