Why the khilafah of Daa3ish is invalid under Islaam

1-It does not meet the definition of khilafah
The Scholars define it as “succession to the Prophet in leadership of the Ummah by establishing Religion and governing the people”.
Obviously, this is because the Prophet was the leader of the Muslims, so his successor inherits that function.
«غياث الأمم في التياث الظلم» (ص22):
«الْإِمَامَةُ رِيَاسَةٌ تَامَّةٌ، وَزَعَامَةٌ عَامَّةٌ، تَتَعَلَّقُ بِالْخَاصَّةِ وَالْعَامَّةِ، فِي مُهِمَّاتِ الدِّينِ وَالدُّنْيَا. مُهِمَّتُهَا حِفْظُ الْحَوْزَةِ، وَرِعَايَةُ الرَّعِيَّةِ، وَإِقَامَةُ الدَّعْوَةِ بِالْحُجَّةِ وَالسَّيْفِ، وَكَفُّ الْخَيْفِ وَالْحَيْفِ، وَالِانْتِصَافُ لِلْمَظْلُومِينَ مِنَ الظَّالِمِينَ، وَاسْتِيفَاءُ الْحُقُوقِ مِنَ الْمُمْتَنِعِينَ، وَإِيفَاؤُهَا عَلَى الْمُسْتَحِقِّينَ»
«منهاج السنة النبوية» (4/ 107):
«وَالثَّانِي: أَنْ يَكُونَ صَاحِبَ يَدٍ وَسَيْفٍ، بِحَيْثُ يُطَاعُ طَوْعًا وَكَرْهًا لِكَوْنِهِ (1) قَادِرًا عَلَى إِلْزَامِ الْمُطِيعِ بِالطَّاعَةِ.
وَقَوْلُهُ تَعَالَى: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنْكُمْ} [سُورَةُ النِّسَاءِ: 59] قَدْ فُسِّرَ بِالْأُمَرَاءِ (2) بِذَوِي الْقُدْرَةِ كَأُمَرَاءِ الْحَرْبِ»
Here Ibn Taymiyyah requires him to have sufficient authority/power to enforce laws within the people over whom he claims leadership, which is REAL, EFFECTIVE authority, as per the 59th Verse of Surah 4: “O believers! Obey Allah and obey the Messenger and those in authority among you.”
Thus, if they have no effective authority on the ground or does not deserve to lead because they lacks the qualification to govern (شروط الأهلية من الأحكام السلطانية), then they are not legitimate leaders.
Can an underground leader of an organisation or militia who does not even have one whole province under its control claim the ability to uphold law and order within the majority of the Ummah?!
2-Their khalifah is incognito
The ones he is supposed to govern (the Ummah) does not know him, nor the majority of Muslim leaders (e.g. Scholars and people working for Islam) know him! Htus, how can we be certain he meets all criteria to qualify for leadership?!
قال الإمام أبو يعلى في [الأحكام السلطانية] (1/23): (لا تنعقد إلَّا بجمهور أهل الحَلِّ والعَقْد)
The Dawa3ish tried to deflect the issue by having their first spokesman use wordplay trickily: “The Ahl-ul-Hill wa al-3aqd in the shura council of the State decided to declare khilafah”.
Clearly, the Ummah do not consider some council of some controversial militant organisation as respected leaders in the first place, so how can they consider their decision binding?!
Thus, have such dialogue with the people:
You:Why do you trust the so-called khalifah?
Him:The leaders of the organisation trust him.
You:And why do you trust them?
Him:Because they are pious Muslims.
You:And how do you know that?
Him:My friends told me and I also had this impression when I watched their videos and read their books.
You:Does this constitute yaqin (certain knowledge)? You’re risking your religion based off hearsay and propaganda.
Him:But we don’t have khilafah and they declared it , so we must help!
You:How can you help people you don’t know and cannot trust? Also, khilafah must be established on the ground before being declared. How can people declare something when it is non-existent?! If it does not meet the definition of Khilafah, it must be something else, like a local Muslim Dawlah (a Muslim State with authority over the locals ONLY) or just kleptocracy and banditry!
3-Khilafah is a reciprocal contract between the khalifah and the Ummah
إِنَّ ٱللَّهَ يَأۡمُرُكُمۡ أَن تُؤَدُّواْ ٱلۡأَمَٰنَٰتِ إِلَىٰٓ أَهۡلِهَا وَإِذَا حَكَمۡتُم بَيۡنَ ٱلنَّاسِ أَن تَحۡكُمُواْ بِٱلۡعَدۡلِۚ [النساء: 58]
«تفسير الطبري» (7/ 169):
«قال عليٌّ كلماتٍ أصاب فيهنّ: حقٌّ على الإمامِ أن يَحْكُم بما أنزَل اللهُ، وأن يُؤَدِّيَ الأمانةَ، وإذا فعَل ذلك، فحقٌّ على الناسِ أن يَسْمَعُوا وأن يُطِيعُوا، وأن يُجيبُوا إذا دُعوا»
4-It was declared without shura with the Muslims
وَٱلَّذِينَ ٱسْتَجَابُوا۟ لِرَبِّهِمْ وَأَقَامُوا۟ ٱلصَّلَوٰةَ وَأَمْرُهُمْ شُورَىٰ بَيْنَهُمْ وَمِمَّا رَزَقْنَـٰهُمْ يُنفِقُونَ
Those who respond to their Lord, establish prayer, conduct their affairs by mutual consultation, and donate from what We have provided for them [42:38]
«تفسير ابن عطية = المحرر الوجيز في تفسير الكتاب العزيز» (1/ 534):
«والشورى من قواعد الشريعة وعزائم الأحكام، ومن لا يستشير أهل العلم والدين فعزله واجب، هذا ما لا خلاف فيه»
Ibn 3Atiyyah Al-Maliki says the imam who does not have shura with the Muslims must be removed from officer by CONSENSUS.
«مصنف عبد الرزاق» (6/ 95 ط التأصيل الثانية):
«عبد الرزاق، عَنْ مَعْمَرٍ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: قَالَ عُمَرُ: اعْقِلْ عَنِّي ثَلَاثًا: الْإِمَارَةُ شُورَى، وَفِي فِدَاءَ الْعَرَبِ مَكَانُ كُلِّ عَبْدٍ عَبْدٌ، وَفِي ابْنِ الْأَمَةِ عَبْدَانِ، وَكَتَمَ ابْنُ طَاوُسٍ الثَّالِثَةَ»
Here, Umar says imarah (leadership) is based on shura.
قال عمر -رضي الله عنه- : " مَنْ بَايَعَ رَجُلًا مِنْ غَيْرِ مَشُورَةٍ مِنَ الْمُسْلِمِينَ فَلَا يُبَايَعُ هُوَ وَلَا الَّذِي بَايَعَهُ تَغِرَّةً أَنْ يُقْتَلَا" رواه البخاري وغيره،
قال ابن حجر -رحمه الله- في الفتح: "والمعنى: أنَّ من فعل ذلك فقد غرر بنفسه وبصاحبه وعرضهما للقتل".
Umar also said in front of the Sahabah and their silence indicates acquiescence.
5-They have committed so much crimes against Islam and Muslims that they cannot be trusted with leadership and they refuse to be trialed under independent Islamic court
إِنَّمَا جَزَٰٓؤُاْ ٱلَّذِينَ يُحَارِبُونَ ٱللَّهَ وَرَسُولَهُۥ وَيَسۡعَوۡنَ فِي ٱلۡأَرۡضِ فَسَادًا أَن يُقَتَّلُوٓاْ أَوۡ يُصَلَّبُوٓاْ أَوۡ تُقَطَّعَ أَيۡدِيهِمۡ وَأَرۡجُلُهُم مِّنۡ خِلَٰفٍ أَوۡ يُنفَوۡاْ مِنَ ٱلۡأَرۡضِۚ ذَٰلِكَ لَهُمۡ خِزۡيٞ فِي ٱلدُّنۡيَاۖ وَلَهُمۡ فِي ٱلۡأٓخِرَةِ عَذَابٌ عَظِيمٌ [المائدة: 33]
وَقَٰتِلُوهُمۡ حَتَّىٰ لَا تَكُونَ فِتۡنَةٞ وَيَكُونَ ٱلدِّينُ كُلُّهُۥ لِلَّهِۚ [الأنفال: 39]
وَإِن طَآئِفَتَانِ مِنَ ٱلۡمُؤۡمِنِينَ ٱقۡتَتَلُواْ فَأَصۡلِحُواْ بَيۡنَهُمَاۖ فَإِنۢ بَغَتۡ إِحۡدَىٰهُمَا عَلَى ٱلۡأُخۡرَىٰ فَقَٰتِلُواْ ٱلَّتِي تَبۡغِي حَتَّىٰ تَفِيٓءَ إِلَىٰٓ أَمۡرِ ٱللَّهِۚ فَإِن فَآءَتۡ فَأَصۡلِحُواْ بَيۡنَهُمَا بِٱلۡعَدۡلِ وَأَقۡسِطُوٓاْۖ إِنَّ ٱللَّهَ يُحِبُّ ٱلۡمُقۡسِطِينَ [الحجرات: 9]
«غياث الأمم في التياث الظلم» (ص120):
«وَأَمَّا التَّمَادِي فِي الْفُسُوقِ إِذَا جَرَّ خَبْطًا وَخَبَلًا فِي النَّظَرِ كَمَا تَقَدَّمَ تَصْوِيرُهُ وَتَقْدِيرُهُ، فَذَلِكَ يَقْتَضِي خَلْعًا وَانْخِلَاعًا»
«غياث الأمم في التياث الظلم» (ص106):
«فَأَمَّا إِذَا تَوَاصَلَ مِنْهُ الْعِصْيَانُ، وَفَشَا مِنْهُ الْعُدْوَانُ، وَظَهَرَ الْفَسَادُ، وَزَالَ السَّدَادُ، وَتَعَطَّلَتِ الْحُقُوقُ وَالْحُدُودُ، وَارْتَفَعَتِ الصِّيَانَةُ، وَوَضَحَتِ الْخِيَانَةُ، وَاسْتَجْرَأَ الظَّلَمَةُ، وَلَمْ يَجِدِ الْمَظْلُومُ مُنْتَصِفًا مِمَّنْ ظَلَمَهُ، وَتَدَاعَى الْخَلَلُ وَالْخَطَلُ إِلَى عَظَائِمِ الْأُمُورِ، وَتَعْطِيلِ الثُّغُورِ، فَلَا بُدَّ مِنِ اسْتِدْرَاكِ هَذَا الْأَمْرِ الْمُتَفَاقِمِ عَلَى مَا سَنُقَرِّرُ الْقَوْلَ فِيهِ عَلَى الْفَاهِمِ - إِنْ شَاءَ اللَّهُ عز وجل وَذَلِكَ أَنَّ الْإِمَامَةَ إِنَّمَا تُعْنَى لِنَقِيضِ هَذِهِ الْحَالَةِ.
152 - فَإِذَا أَفْضَى الْأَمْرُ إِلَى خِلَافِ مَا تَقْتَضِيهِ الزَّعَامَةُ وَالْإِيَالَةُ، فَيَجِبُ اسْتِدْرَاكُهُ لَا مَحَالَةَ»
(يقول ابن تيمية:
«وولي الأمر إذا ترك إنكار المنكرات وإقامة الحدود عليها بمالٍ يأخذه= كان بمنزلة مُقَدَّم الحراميَّة

وولي الأمر إنما نُصِبَ ليأمر بالمعروف وينهى عن المنكر، وهذا هو مقصود الولاية، فإذا كان الوالي يُمَكِّن من المنكر بمالٍ يأخذه= كان قد أتى بضد المقصود، مثل من نَصَبْتَه ليعينك على عدوِّك، فأعان عدوَّك عليك، وبمنزلة من أخذ مالًا ليجاهِدَ به في سبيل الله تعالى، فقاتلَ به المسلمين

«فكلُّ طائفةٍ ممتنعة عن التزام شريعة من شرائع الإسلام الظاهرة والمتواترة يجب جهادُها حتى يكون الدين كلُّه لله، باتفاق العلماء»
«السياسة الشرعية في إصلاح الراعي والرعية» (ص 95-98 ط عطاءات العلم):
«مجمع الزوائد ومنبع الفوائد» (5/ 228):
وَعَنْ ثَوْبَانَ قَالَ: قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم: " «اسْتَقِيمُوا لِقُرَيْشٍ مَا اسْتَقَامُوا لَكُمْ فَإِذَا لَمْ يَفْعَلُوا فَضَعُوا سُيُوفَكُمْ عَلَى عَوَاتِقِكُمْ فَأَبِيدُوا خَضْرَاءَهُمْ فَانْ لَمْ تَفْعَلُوا فَكُونُوا حِينَئِذٍ زَرَّاعِينَ أَشْقِيَاءَ تَأْكُلُونَ مِنْ كَدِّ أَيْدِيكُمْ» ".
رَوَاهُ الطَّبَرَانِيُّ فِي الصَّغِيرِ وَالْأَوْسَطِ، وَرِجَالُ الصَّغِيرِ ثِقَاتٌ
Thus, when the government deviates from the fundamental principles of governance
(مقاصد الإمامة), corrective measures, including the use of force, may be necessary to restore order and uphold the principles of Islamic good governance.
Some of their crimes:
1-Provoked the West into bombing Iraq and Syria and displacing or killing hundreds of thousands of Sunni Muslims only for the atheists of Rojava and others to take over.
2-Given the West the pretext to redraw the Middle Eastern map in favor of Israel, whose survival needs mini-States governed by religious minorities in order to contain the Sunni majority
3-Backstabbed and divided the Muslims when they were about to win the Arab Spring.
4-Given Islam and Muslims a barbaric image
5-Exposed Muslim women and children to r@pe and enslavement by the kuffar in retaliation.
6-Increased Islamophobia, crimes and laws against Muslims.
7-Betrayed the trust of Muslims and non-Muslims (e.g. killing Islamophile kuffar)
8-Gathered thousands of sincere people and local Muslims only for them to die under the bombs
9-Discredited, killed and track down their own “scholars” and fought between themselves.
Who benefits from such mischief and corruption? Why would they give him such an immense service in disfavor of Islam?
